这题不仅仅存在原题提到的提前装运的问题,也没有按合同要求每月分批装运及等量交货两个问题,而不是原题提到的“有装运港交货和目的港交货两种方式”,这里根本不存在装运港或者是目的港交货的问题。信用证规定最迟装运为6月30,合情合理是指装运港交货。进出口贸易中,卖方理应按照买卖合同的要求严格执行,很明显,这样交货存在很大的问题。第一,既然合同规定交期为当年12年至次年月日6月,每月等量装运一定量米,如果有100吨大米,每批应交吨,最早一批装运是在当年12月,最后一批应该在次年6月,但信用证规定最迟装运期为6月30日,这说明最后一批装运的时间可以在6月1日到6月30日都可以,具体时间,可以根据信用证的有效期以及卖方的实际情况执行,因为装运后还需要时间准备成套单据与银行议付。这是合同的理解。第二,你方这样做,其实很大机会被客户拒付,但由于银行审单的时候,是按照信用证来审核,又不会理会合同是怎样规定的,所以只要你方所提交的整套单据与信用证相付,银行即需凭单认付。在这种情况下,什么情况会被客户拒绝呢?就是由于大米价格波动大的时候,而且给客户造成损失的情况下,或者是客户自身出现问题,想违约即可以此做借口,客户完全有理由要求拒绝付款。
