法律分析：承诺迟延的情形：
1、逾期承诺
逾期承诺是指受要约人在承诺期限届满后发出承诺而使承诺迟延。逾期承诺是受要约人向要约人发出的同意接受要约的意思表示，因为它作出的时间晚于要约确定的承诺期限，所以不符合有效承诺的全部要件，不能发生承诺的法律效力。
2、承诺迟到
承诺迟到是指受要约人在承诺期限内发出承诺，但因其他原因而使承诺迟到。承诺迟到与逾期承诺不同，逾期承诺是在发出时就已超出承诺期限，而承诺迟到却是在承诺期限内发出，只是在到达要约人时超出承诺期限。
法律依据：《中华人民共和国民法典》
第四百八十六条 逾期承诺有两种效力：一是要约人及时通知承诺人，承认该承诺有效的，合同成立是如果要约人接到逾期承诺后未及时通知承诺人该承诺有效的，就只能作为一个新的要约，而不能认为是承诺。
第四百八十七条 受要约人在承诺期限内发出承诺，按照通常情形能够及时到达要约人，但因其他原因承诺到达要约人时超过承诺期限的，除要约人及时通知受要约人因承诺超过期限不接受该承诺的以外，该承诺有效。
