Downsizing and Layoffs 裁员缩支When your business has to unfortunately downsize or lay employees off, there are resources and assistance the federal government offers to businesses and employees. 当你的公司很不幸要裁员缩支的时候,联邦政府将会为公司和员工提供资源和援助。The Worker Adjustment and Retraining Notification Act (WARN) protects workers, their families, and communities by requiring employers with 100 or more employees (generally not counting those who have worked less than six months in the last 12 months and those who work an average of less than 20 hours a week) to provide at least 60 calendar days advance written notice of a plant closing and mass layoff affecting 50 or more employees at a single site of employment. The WARN Act is a federal statute; many states have enacted similar legislation and some of those states require that the provisions of the Act apply to businesses with less than 100 employees. 裁员是经济性裁员的简称,是因用人单位的原因解除劳动合同的情形。该词指的是用人单位在法定的特定期间依法进行的集中辞退员工的行为。实施经济性裁减人员的企业,可以裁减因生产经营状况发生变化而产生的富余人员。

企业在两种情况下可以裁减人员:一种情况是濒临破产,被人民法院宣告进入法定整顿期间;另一种情况是生产经营发生严重困难,达到当地政府规定的严重困难企业标准。

此外,企业裁减人员,还应当严格依照法律和有关规章规定的程序进行。企业只有具备了法定条件并严格按照法定程序进行,裁减人员才是合法的,以裁减人员的方式与职工解除劳动合同才是有效的。

裁员的好处是大家都很在意投诉之类的反馈,团队的凝聚力更强,执行力得到提高。裁员是公司利润要求与文化要求。公司亏损的背后是团队,团队的背后是文化与心态,而改变文化与心态最好的办法就是换帅与裁员。裁员的表面是成本缩减,但背后却是业绩文化的强硬逻辑。
