United States Senate的创始时期

在《邦联条例》（Articles of Confederation）中，邦联国会（Congress Assembled）为单院制，各州代表同额。

在该条例约制下，国会召集合众国（The United States in Congress Assembled，USCA）政府运作的无效性使得邦联国会于1787年在费城召开美国制宪会议。各州除罗得岛州外都同意委派代表与会。

许多州代表吁求增设国会第二议院，并以英国上议院（House of Lords）为原型。例如，约翰·狄金森主张“国会第二议院应由最具身份、地位与财富的高贵人士所组成，与不列颠上议院越相似越好。”
