sea waybill 是海运单,不是海运提单海运提单是ocean bill of lading 首先SEAWAYBILL不是物权凭证,想当然的只要把SEA WAYBILL拿到船公司人家就会放货,那就错了。签发SEAWAYBILL的货物,在目的港多数国家可不用出示SEA WAYBILL 或只要出示WAYBILL单的COPY,在验证收货人身份后就可提货(部分国家或地区按照当地政策不能签SEA WAYBILL)。所以在实践中,有些客户只要WAYBILL的传真件就是这道理。 接上面,SEA WAYBILL的收货人必须记名,TO ORDER或OT ORDER OF XXX是不可能形成SEAWAYBILL的。这是SEA WAYBILL是一个要求,这样目的港只要将前来提货的人的身份同WAYBILL单上的收货人进行核对,只要一致就可放货。 现在很多人在船公司可签发SEA WAYBILL的情况下,已经把SEA WAYBILL等同于电放,从操作中来讲确实是很类似。还可以少交电放的费用

一、概念不同

1、海运提单

海运提单简称提单,是船方或其代理人签发的,证明已收到货物,允许将货物运至目的地,并交付给托运人的书面凭证。它是承运人和托运人之间的契约证明,在法律上具有物权证书的效用。

2、海运单

海运单,是指证明海上货物运输合同和承运人接收货物或者已将货物装船的不可转让的单证。海运单的正面内容与提单的基本一致,但是印有“不可转让”的字样。

有的海运单在背面订有货方定义条款、承运人责任、义务与免责条款、装货、卸货与交货条款、运费及其他费用条款、留置权条款、共同海损条款、双方有责碰撞条款、首要条款、法律适用条款等内容。

二、凭证不同

1、提单是货物收据、运输合同的证明、也是物权凭证。

2、海运单只具有货物收据和运输合同这两种性质,它不是物权凭证。

三、流通转让不同

1、提单可以是指示抬头形式,可以背书流通转让。

2、海运单是一种非流动性单据,海运单上标明了确定的收货人,不能转让流通。

四、形式不同

1、海运单和提单都可以作成"已装船(Shippedonboard)形式,也可以是"收妥备运"(Receivedforshipment)形式。

2、海运单的正面各栏目的格式和缮制方法与海运单提单基本相同,只是海运单收货人栏不能做成指示性抬头应缮制确定的具体收货人。
